These terms govern the use of the JOuHealth application. The operator is JOUGROUP s.r.o., company ID 19707673, VAT ID CZ19707673, D-U-N-S 983950506, with registered office at Václavské náměstí 808/66, Nové Město, 110 00 Prague 1, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, section C, file 390445 (the operator).
1. What JOuHealth is
JOuHealth is a personal health data platform. It lets you gather your own health data in one place (blood tests, genetics, microbiome, continuous glucose, body composition, wearable data), view it clearly and generate an indicative, educational summary.
JOuHealth is an informational and educational tool. It is not a health service, not medical care and does not replace a doctor. See the separate Medical Disclaimer.
2. Account and access
Sign-in is passwordless, via a one-time link sent to your e-mail (magic link). You are responsible for the security of your e-mail account.
During the private test, access is invite-only. The account is personal. You can, however, deliberately grant another account access to your profile, and you can keep profiles of family members within your account, see article 3.
3. Family profiles, minors and sharing access
Besides your own profile, you can keep profiles of family members or people in your care (for example children) within your account and manage their health data. As the profile manager you are responsible for keeping another person's profile.
You may create a profile for another person only if you are their legal guardian or hold other verifiable authority. For a person aged 15 or older, health and genetic data cannot be entered or made accessible until that person obtains their own sign-in, receives the processing information and gives their own valid explicit consent, unless JOUGROUP s.r.o. has verified other legal representation in advance. A profile manager's declaration does not by itself replace the data subject's consent.
JOUGROUP s.r.o. is the controller for processing carried out by the JOuHealth platform. A person who keeps a profile for a family member or a person in their care is called a profile manager in these Terms. That label does not by itself make the person a controller under the GDPR. A profile manager may submit data only where they have valid authority to do so. This version of JOuHealth is not intended for employers, healthcare or social care providers, or other professional management of another person's profile without a separate agreement with JOUGROUP s.r.o.
The date of birth on a managed profile is set and changed only by the profile manager or an administrator. The profile subject themselves (for example a child with their own sign-in) cannot change the date of birth. This field serves to protect minors.
For the profile of a person under 18, immediate self-service deletion in the application may be restricted so that an irreversible action does not happen without verification of an authorised person. This does not limit the right of the child or their legal guardian to request erasure, restriction or rectification, or to withdraw consent, at info@jouhealth.com. We assess every request without undue delay in accordance with the GDPR, after proportionate verification of identity and authority and with regard to the best interests of the child.
A managed member can be given their own sign-in (promotion to a standalone account). For minors, we verify who is entitled under applicable law to act and to give consent, taking into account the child's age and maturity, the nature of the processing and parental responsibility. Under Czech law, the threshold of 15 years applies to consent in connection with the direct offer of an information society service to a child. For health and genetic data, we may require the legal guardian's consent, the child's own consent or both before activation, and we may proportionately verify the guardian's authority.
If a manager deletes their account while having promoted members with their own sign-in, those members' health data is preserved and management of the profile passes to that member, so they can continue to manage their data themselves.
You can grant another existing account access to your profile (by e-mail). Sharing is one-directional and read-only: the other party can see the profile data but cannot change or delete it. You can revoke access at any time and revocation is immediate. Share only with people you trust; by sharing you take responsibility for who you give your data to.
4. Your data and your responsibility
You retain the rights to your personal data and uploaded content that applicable law grants you. By uploading, you give us only the permission necessary to provide the features you have requested, within the scope of the Terms and the Privacy Policy. Your rights of access, portability, rectification, restriction and erasure remain unaffected. You are responsible for having the right to upload the data and for its accuracy. Incorrectly uploaded or mislabelled data can lead to a misleading summary.
You agree not to misuse the application, not to upload other people's data without authorisation, and not to circumvent security.
5. Scope of service and limitation of liability
JOuHealth gives no guarantee of a specific health outcome. AI and automated outputs may be incomplete or incorrect and the user must not use them as the sole basis for a health decision. This limitation describes the nature of the service; it does not exclude the liability of JOUGROUP s.r.o. for breach of contractual or statutory obligations, for defects of the digital service, or any other liability that cannot be limited under applicable law. You are responsible for your health decisions, together with your doctor.
The summary is generated by a language model (see the Privacy Policy). It may contain inaccuracies. It does not serve to establish a diagnosis or to prescribe medication.
Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited, including mandatory consumer rights and liability for intentional or grossly negligent conduct. The Medical Disclaimer defines the intended purpose of the service but does not replace the user's statutory rights.
6. Price, duration and termination
During the private test, JOuHealth is provided free of charge and the agreement is concluded for an indefinite period. You may terminate it at any time by deleting the account in Settings or by notifying info@jouhealth.com. Termination does not affect rights that continue by law. Your mandatory consumer rights, including rights relating to defective performance and any applicable right to withdraw from a distance contract, remain unaffected to the extent they apply to the service. We will provide price information and specific terms before introducing any paid version.
7. Governing law and dispute resolution
The relationship is governed by Czech law, in particular the Civil Code (No. 89/2012 Coll.) and the Consumer Protection Act (No. 634/1992 Coll.). Czech courts have jurisdiction.
You may first submit comments or complaints to info@jouhealth.com. If a consumer dispute arising from a service contract cannot be resolved by agreement, the consumer may submit a request for alternative dispute resolution to the Czech Trade Inspection Authority, Central Inspectorate, ADR Department, Gorazdova 1969/24, 120 00 Prague 2, Czech Republic, e-mail adr@coi.gov.cz, website https://coi.gov.cz/informace-o-adr/. This does not affect the right to bring the matter before a court. The former EU ODR platform is not used because it has been discontinued.
8. Changes to the terms
We may change the Terms because of changes in law, security, service functionality or suppliers. We will notify you of a material change in a durable form within a reasonable period before it takes effect. If the change more than minimally impairs your use of the service, you may terminate the agreement without penalty within 30 days after notice or the change takes effect, whichever is later, unless we allow you to retain the previous version without impairment. We will request new consent whenever the purpose or scope of consent-based processing changes. The version shown at the top always applies.
